One of the most common questions we get at Sydney Car Dismantlers is this: my car is unregistered, can I still sell it?
The short answer is yes. You can absolutely sell an unregistered vehicle in NSW, and in most cases the process is straightforward. But there are legal steps you need to follow to protect yourself, and a few things that can catch sellers off guard if they are not aware of them.
This guide covers everything you need to know, from what the law actually says, to how to transfer ownership correctly, to what happens if you skip a step.
Is It Legal to Sell an Unregistered Car in NSW?
Yes, it is completely legal to sell an unregistered vehicle in NSW. There is no law that requires a car to be registered at the time of sale. Registration is a requirement for driving on public roads, not a requirement for ownership transfer.
What matters legally is that:
- You are the rightful owner of the vehicle
- You transfer ownership correctly using the proper NSW paperwork
- You notify Transport for NSW of the sale
That is it. The buyer takes on responsibility for the vehicle, including any decision about whether to re-register it or scrap it, once the transfer is complete.
What Paperwork Do You Need?
Selling an unregistered vehicle in NSW requires the same core paperwork as selling a registered one. Here is what you need to have ready:
1. Proof of ownership
This is typically the Certificate of Registration issued by Transport for NSW. If you have lost yours, you can request a replacement through Service NSW. You will need to show photo ID.
If the vehicle was never registered in your name, for example you inherited it or bought it informally, you will need to establish a paper trail showing how you came to own it. This can include a statutory declaration in some cases.
2. The vehicle itself, with its VIN and engine number
The buyer or dismantler will need to verify that the VIN on the vehicle matches the paperwork. Make sure the VIN plate, usually on the dashboard or door jamb, is visible and legible.
3. A completed Notice of Disposal
This is the critical step that many private sellers skip, and it is the one that causes the most problems.
The Notice of Disposal – Do Not Skip This
When you sell any vehicle in NSW, registered or not, you are legally required to notify Transport for NSW that you have disposed of it. This is done by submitting a Notice of Disposal.
You can do this:
- Online at myservicensw.com.au
- In person at any Service NSW centre
- By phone through Service NSW on 13 77 88
Why does this matter?
If you sell your unregistered car and do not submit a Notice of Disposal, you remain the recorded owner in the Transport for NSW database. If the new owner or a dismantler does something irregular with the vehicle, any fines, notices, or legal issues can come back to you as the last recorded owner.
This has happened to sellers who handed over a vehicle informally and assumed the buyer would handle the paperwork. Submitting a Notice of Disposal takes five minutes and completely protects you from future liability.
Does the Car Need a Pink Slip to Be Sold?
No. A pink slip (eSafety Inspection Report) is required to register a vehicle, not to sell it. If you are selling an unregistered car to a dismantler or a wrecker, no pink slip is needed at any point.
If you are selling privately to someone who intends to re-register the vehicle, that is their responsibility. The buyer will need to obtain a pink slip before Transport for NSW will issue new registration.
Does Stamp Duty Apply to Unregistered Vehicles?
Stamp duty in NSW is applied when a vehicle is registered, not when it is sold. If you are selling an unregistered car to a dismantler who will never register it, stamp duty is not relevant to the transaction.
If the buyer intends to re-register the vehicle, they will pay stamp duty to Transport for NSW at the time of registration. That is the buyer’s responsibility and cost, not yours as the seller.
Can You Drive an Unregistered Car to the Buyer?
No. Driving an unregistered vehicle on a NSW public road is illegal regardless of the reason for the trip, including driving it to a buyer or a dismantler. The penalties include:
- A fine of over $600
- Possible vehicle impoundment
- Demerit points on your licence
If your vehicle is unregistered and cannot be driven legally, the solution is simple. Use a car removal service that comes to you. At Sydney Car Dismantlers, we collect unregistered vehicles directly from your property at no charge. You do not need to move the car anywhere.
What If the Car Has Outstanding Fines or Encumbrances?
Before selling any vehicle, registered or not, it is worth doing a PPSR check (Personal Property Securities Register check) to confirm there is no financial encumbrance on the vehicle, for example an outstanding car loan.
You can run a PPSR check at ppsr.gov.au for a small fee (currently $2.00 per search). This protects both you and the buyer. If there is an encumbrance on the vehicle, the lienholder, typically a bank or finance company, has a legal claim over it, and a sale without resolving that claim can be challenged.
Outstanding traffic fines do not prevent a sale, but they remain the responsibility of whoever incurred them. If the fines are in your name, they stay in your name regardless of who owns the car now.
What If You Have Lost the Paperwork?
This is more common than people think, particularly with older vehicles that have been sitting unregistered in a garage for years. Here is what to do:
Lost Certificate of Registration:
Apply for a replacement at any Service NSW centre with photo ID. There is a small replacement fee.
Vehicle not registered in your name:
If the car was transferred to you informally, bought at a market, inherited, or received as a gift, and you have no paperwork, you will need to make a statutory declaration explaining the circumstances. Service NSW can advise on the exact process for your situation.
VIN plate missing or illegible:
This complicates things. A licensed dismantler will still be able to process the vehicle in most cases, but contact us first to discuss your specific situation before arranging collection.
Selling an Unregistered Car to Sydney Car Dismantlers – How It Works
We buy unregistered vehicles every day. The process is identical to selling a registered car:
- Call us or fill in our online form with your vehicle details including make, model, year, and condition. We do not need registration status to give you a quote.
- Receive a firm cash offer within one minute. Unregistered vehicles are valued the same way as registered ones, based on make, model, condition, and parts value. Registration status does not reduce your payout.
- Book a free collection at a time that suits you. We come to your home, workplace, or wherever the vehicle is located. You do not need to move it.
- We handle the paperwork. Our team brings the necessary transfer documentation. You sign, we verify the VIN, and we pay you on the spot.
- Submit your Notice of Disposal. We strongly recommend doing this yourself through Service NSW as soon as the vehicle leaves your property. It takes five minutes and fully protects you as the former owner.
